Sales regulations
The regulations are the document referred to in art. 8 of the Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended).

§1 Definitions

The terms used in the content of these Regulations have the meaning given below, unless the content of the Regulations clearly indicates a different meaning:

  1. Book – whenever the Regulations refer to the Book in the singular, it should be applied accordingly to the plural and vice versa. Whenever the Regulations refer to the Book, this also applies to its electronic version and audiobook.
  2. Proof of Purchase – an invoice or other document confirming the purchase of a Book, e.g. a credit card printout, e-mail confirmation.
  3. Customer Service Department – a point providing information to Users. Contact with the Customer Service Department is possible by phone or e-mail on Business Days from 10:00 to 16:00. Telephone: +48 519 400 317, email: [email protected]. The fee for connecting to the Customer Service Department is in line with the tariff of the telecommunications operator used by the User.
  4. Working day – every day, except Saturdays, Sundays and other statutory holidays.

  6. Regulations – these Regulations for the sale of Books.
  7. System – a computer system for the sale and distribution of Books made available by Leanpassion on the website published under the domain radekdrzewiecki.pl.
  8. User – any person using the System at www.radekdrzewiecki.pl and purchasing Books via the System.

§2 General rules

  1. These Regulations contain provisions on the sale and distribution of Books using the System at www.radekdrzewiecki.pl.
  2. The User using the System accepts the terms of these Regulations.
  3. Before purchasing a Book on the website www.radekdrzewiecki.pl, the User is obliged to read the Regulations and any additional information published by Leanpassion on this website.

§3 Stages of the Book purchase process at www.radekdrzewiecki.pl

  1. The process of purchasing Books sold and distributed by Leanpassion using the System consists of the following stages:
    • selection of the Book;
    • selecting the quantity and adding it to the basket;
    • confirmation of the purchase by clicking the Go to payment button;
    • providing address data necessary for the execution of the order and shipping;
    • verification of the order and acceptance of the terms of purchase by clicking the button I order with the obligation to pay;
    • confirmation by the User of the order with the obligation to pay;
    • choosing the method of payment for the Book – making a payment;
    • confirmation of the terms and execution of the order by Leanpassion.
  2. In order to place an order and purchase a Book in the System, the User should complete the data necessary to complete the order, i.e .:
    • name and surname;
    • email address;
    • company name and data identifying it (if the invoice is to be for the company);
    • address: street, house / flat number, zip code, city and country;
    • contact telephone number.
  3. Leanpassion shall not be liable for incorrect entering of data by the User into the System or for changing data in the System by the User, in particular address data. If the User notices an error in the data provided by him after confirming the order, he should contact the Customer Service Department.
  4. Leanpassion reserves the right to suspend orders that raise doubts.

§4 Choosing the method of payment for the Book

  1. The User may pay for the Book in the following way:
    • by transfer on the basis of a proforma invoice;
    • via the Przelewy24 website (in accordance with the regulations of this website) or another online payment intermediary – https://www.przelewy24.pl/;
  2. All possible costs related to the payment for the Book, in the manner provided for in this provision of the Regulations, shall be borne by the User.
  3. Leanpassion reserves that some payment methods for the order may be temporarily unavailable.
  4. All information on the available forms of payment for the Book will be provided on the website www.radekdrzewiecki.pl. The amount due under the order should be paid in full immediately after placing the order, not later than within 7 days from the date of placing the order with the obligation to pay.

§5 Completion of the Book purchase process

  1. After selecting the type and quantity of the Book, the method of payment, the User is obliged to accept the terms of purchase of the Book, check the data entered by the User into the System, and confirm the willingness to complete the order by pressing the “Order with payment obligation” or other equivalent button. After accepting the terms of purchasing the Book, Leanpassion sends confirmation of the order and conclusion of the contract.
  2. The contract is concluded after the User confirms the order with the obligation to pay.
  3. Failure to pay the order on time, in accordance with § 4 sec. 3, will be considered as the User’s withdrawal from the contract and such order will be automatically canceled.
  4. In the event of cancellation of the order in accordance with point 3 above, it is not possible to restore it, but it is only possible to place a new order. In this case, Leanpassion cannot guarantee that the selected Books will still be available.
  5. Leanpassion is entitled to cancel the order if:
    •  the User has made the payment using stolen credit cards;
    • the order has not been paid within the time limit specified in § 5 sec. 3;
  6. In the indicated in sec. 5 lit. and in the case of Leanpassion, it is entitled to report the event to the competent law enforcement authorities.

§6 The right to withdraw from the Agreement

  1. The User who is a consumer has the right, within 14 days from the date of purchase of the Book, to withdraw from the contract for the purchase of the Book, without giving any reason. For this purpose, he may use the form attached as Appendix 1 to these Regulations. To meet the deadline referred to in the previous sentence, it is enough for the User to send a statement of withdrawal before the expiry of this deadline.
  2. The declaration of withdrawal from the contract may be submitted in writing to the following address: Drzewiecki Radosław Leanpassion, ul. Komitet Obrony Robotników 48, 02-146 Warsaw or electronically to the following address: [email protected].
  3. Withdrawal from the Agreement referred to in paragraph 1, does not require giving a reason and takes place without additional costs for the User who is a consumer.

§7 Complaints procedure

  1. All complaints should be reported by the User to the Customer Service Department via the e-mail address: [email protected] or by registered letter sent according to the Leanpassion correspondence address.
  2. Complaints may be submitted during the opening hours of the Customer Service Department, on Business Days from 10:00 to 16:00.
  3. If the delivered Book is destroyed, damaged or inconsistent with the order, the User should immediately notify Leanpassion, in the manner provided for in point 1 above. In the event of receipt of such a complaint, Leanpassion will each time contact the User.
  4. Responses to complaints will be provided immediately, not later than within 14 days from the date of notification.

§8 Responsibility

  1. The User should inform Leanpassion about any irregularities in the functioning of the System. Leanpassion is not responsible for the temporary unavailability of the System, which results from technical reasons or circumstances beyond Leanpassion’s control and beyond the control of Leanpassion (force majeure).
  2. Leanpassion is not responsible for sending the Book to the wrong address or sending a message with information about the order to the wrong e-mail address, if the data has been incorrectly provided by the User.
  3. Each party is obliged to repair the damage caused to the other party as a result of non-performance or improper performance of its obligations, unless the non-performance or improper performance is a consequence of circumstances for which the party is not responsible.

§9 Statements and other provisions

  1. In matters not covered by these Regulations, the provisions of the Civil Code and the Act on the protection of consumer rights shall apply.
  2. With regard to all matters related to a given order, the Regulations in force on the day the order is placed shall apply.
  3. In the event of disputes with the User, the court competent to hear them is the common court competent for Leanpassion.
  4. All notifications and further correspondence between Leanpassion and the User should be directed to the addresses indicated in the Regulations and the order form.
  5. Declaration by a competent court of invalidity of some provisions of the Regulations shall not affect its other provisions, which in such a case shall remain in force.
  6. In matters not covered by these Regulations, the provisions of Polish law shall apply accordingly. Leanpassion and the User submit any disputes arising in connection with the performance of the contract to the jurisdiction of Polish courts, and in the case of a User who is not a Consumer, the only court having jurisdiction is the court competent for the seat of Leanpassion.
  7. By placing an order for a Book with an obligation to pay, the User accepts the conditions specified in the order form and in the Regulations as the terms of the contract binding him / her with Leanpassion.
  8. Before placing an order, the User reads the content of the Regulations and the order form and made sure that their provisions are understandable, complete and do not contain errors. In the event of errors and inaccuracies, the User should contact Leanpassion in order to confirm in writing any changes he has made to the Regulations.
  9. Leanpassion is only responsible for declarations of will made in writing by authorized employees and agents.
  10. The user who is a consumer acknowledges that he has the option of using out-of-court complaint and redress procedures related to the contract, including the assistance of the Municipal Consumer Ombudsman, acting pursuant to the Act of February 16, 2007 on competition and consumer protection (Journal of Laws No. Of 2007, No. 50, item 331, as amended). The consumer also has the option of using an out-of-court complaint and redress procedure before the Permanent Consumer Arbitration Court at the Provincial Inspector of Trade Inspection in Warsaw.
